Terms and Conditions for Car Identifier

1. Introduction

Welcome to Car Identifier ("the Tool"), owned and operated by Kawaii, Inc. ("we", "us", or "our"). These Terms and Conditions ("T&C") govern your use of Car Identifier and all related services.

2. Acceptance of Terms

By accessing or using Car Identifier, you agree to be bound by these T&C. If you disagree with any part of the terms, you may not use Car Identifier.

3. Disclaimer Agreement

By using Car Identifier, you also agree to the terms outlined in our AI Identification Disclaimer. The Disclaimer includes important information about the limitations of our AI-powered identifications and of every other piece of information presented on Car Identifier — including the encyclopedia, reference pages, guides, articles, and community submissions — all of which may contain errors, omissions, or outdated information and must not be relied on as expert, safety, medical, legal, or financial advice. The Disclaimer is an integral part of these Terms, and your use of Car Identifier is subject to your acceptance of both.

4. Encyclopedia and Reference Content

Car Identifier may include an encyclopedia, reference pages, guides, articles, and other informational content (“Reference Content”). Reference Content is compiled and generated with the help of automated tools and AI models and is provided for general informational purposes only. It may contain errors, omissions, or outdated information, and it has not been reviewed by qualified experts. We make no representation or warranty as to the accuracy, completeness, or reliability of any Reference Content or of any other information presented on Car Identifier, and you agree not to rely on it as a substitute for professional advice or for any decision that could affect your health, safety, property, legal rights, or finances. Images shown with Reference Content may be illustrative rather than exact matches. If you believe something is wrong, please let us know at support@caridentifier.com and we will review it.

5. Description of Service

Car Identifier uses artificial intelligence to provide vehicle identifications and estimated market information. These identifications are for informational purposes only and should not be considered as official valuations.

6. User Responsibilities

You are responsible for:

• Providing accurate information for identifications
• Using Car Identifier in compliance with all applicable laws and regulations
• Maintaining the confidentiality of your account information
• Any decisions made based on Car Identifier's identifications
• Reading and understanding the Disclaimer at caridentifier.com/disclaimer

7. Intellectual Property

Car Identifier, including its software, design, and content, is protected by copyright, trademark, and other laws. Kawaii, Inc.'s trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Limitation of Liability

We provide Car Identifier on an "as is" and "as available" basis. We do not guarantee the accuracy, completeness, or usefulness of any identifications. Kawaii, Inc. will not be liable for any losses or damages arising from your use of, or reliance on, Car Identifier.

9. Disclaimer of Warranties

Kawaii, Inc. disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. User Content

By submitting information to Car Identifier, you understand and agree that your submitted images and resulting identifications will be publicly displayed on our platform and indexed by search engines. You grant Kawaii, Inc. a worldwide, non-exclusive, royalty-free license to publicly display, reproduce, and distribute such content. Do not submit images containing personal information or vehicles you wish to keep private. The full license you grant us is described in the section titled “License Grant to Car Identifier” below.

11. License Grant to Car Identifier

By using Car Identifier and its related apps, websites, and services (the “Services”), you grant to Car Identifier, its successors, and assigns a perpetual, worldwide, non-exclusive, sublicensable, no-charge, royalty-free, irrevocable copyright license to use, copy, reproduce, process, adapt, modify, publish, transmit, prepare derivative works of, publicly display, publicly perform, sublicense, and/or distribute any content you submit, create, or make available through the Services — including without limitation the photos and images you upload for identification; the notes, descriptions, locations, and other text you provide with them; the identifications, descriptions, estimates, and any other output produced by the Services at your direction; any collections, lists, or albums you assemble, including their names and the selection and arrangement of the items they contain; and your profile information, including your username, display name, profile picture, bio, and any links you add — regardless of whether an identification’s or collection’s visibility is public or private. This includes the right to display your uploaded photos and identifications on the community feed, on encyclopedia, species, tag, and search pages, on the websites and apps of Car Identifier and its affiliates, and in marketing for the Services. For clarity, changing an identification’s or a collection’s visibility from public to private does not revoke or limit the license granted under this section with respect to that identification, that collection, or any content associated with it. The license granted to Car Identifier remains in effect even after termination of this Agreement by any party, for any reason.

12. Termination

Kawaii, Inc. reserves the right to terminate or suspend access to Car Identifier immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the T&C.

13. Changes to Terms

We reserve the right to modify or replace these T&C at any time. We will provide notice of any significant changes. Your continued use of Car Identifier after any such changes constitutes your acceptance of the new T&C.

14. Governing Law

These T&C shall be governed and construed in accordance with the laws of the jurisdiction in which Kawaii, Inc. is based, without regard to its conflict of law provisions.
